IMPORTANT: PLEASE READ THESE OFFICIAL RULES BEFORE ENTERING THE #NATIONALGOLFDAY SWEEPSTAKES. BY ENTERING THE SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES. NO PURCHASE NECESSARY TO ENTER OR WIN.
VOID WHERE PROHIBITED OR RESTRICTED BY LAW. SWEEPSTAKES IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AT THE TIME OF ENTRY.
ELIGIBILITY: #NationalGolfDay Sweepstakes is open to individuals 18 years old or older as of the date of entry who are legal residents of the United States. Persons in any of the following categories are NOT eligible to win a prize: (a) employees or agents of World Golf Foundation/WE ARE GOLF (the “promoter”), Buffalo.Agency (“Administrator”), and their respective parent companies, subsidiaries, affiliates, distributors, advertising and promotion agencies; (b) individuals engaged in the development, production or distribution of materials for the Sweepstakes; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandmother, grandfather, children or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law.
HOW TO ENTER: Sweepstakes begins 6:00 PM Eastern Standard Time (EST) on April 22nd, 2019 and ends at 11:59 PM (EST) on May 4th, 2019 (the “Sweepstakes Period”). To enter, share a photo to your Instagram feed of how you are celebrating National Golf Day and tag #NationalGolfDay and @WeAreGolf. Entries received after the Sweepstakes Period will be deemed ineligible to win. Limit of ONE (1) entry per day per person/Instagram account throughout the Sweepstakes Period.
SWEEPSTAKES ENTRIES: Promoter and its subsidiaries, affiliates and/or agencies are NOT responsible for lost, late, incomplete, illegible entries or e-mail, mutilated, destroyed, damaged, delayed, falsified, incomprehensible, misdirected, undelivered, garbled, or stolen entries; computer errors; failures in servers or other connections or communications; or other errors of any kind nor for any injury or damage to an entrant’s or other person’s computer related to or resulting from participation in the Sweepstakes. All entries become the sole property of Promoter and will not be returned or acknowledged. All entry information will be held and used in accordance with the Official Rules and the Promoter’s Privacy Policy located at https://wearegolf.com/national-golf-day-sweepstakes. In the event of a dispute concerning the identity of an entrant, the authorized account holder of the e-mail address submitted at time of entry will be deemed to be the entrant. An “authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider associated with the Instagram account, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
GRAND PRIZE: Four (4) winners will receive an American Flag headcover from Rocket Tour. Approximate Retail Value (“ARV”) of Grand Prize is $30. Prizes listed are subject to availability. Prize will be awarded by Administrator. ALL FEDERAL, STATE, AND LOCAL TAXES ARE THE SOLE RESPONSIBILITY OF THE GRAND PRIZE WINNER.
RANDOM DRAWING AND NOTIFICATION: The random drawing for the Grand Prize(s) will be selected on or about May 6th, 2019. The odds of winning depend on the number of eligible entries received during the Sweepstakes Period. The potential Prize winners will be notified via Instagram message within approximately one (1) day of the random drawing. If the potential Prize winners cannot be reached or fails to respond for a period of one (1) calendar days following first attempted notification, is found to be ineligible or not in compliance with these Official Rules, declines to accept the Grand Prize, or if Administrator’s notification is returned as undeliverable, or the potential Prize winner is otherwise unreachable for any reason, the Prize will be forfeited and Administrator may award the Prize to a randomly-selected alternate winner.
The Prize will be sent to the winner within 2 – 3 weeks after confirmation of eligibility. The potential Prize winners may be sent an Affidavit of Eligibility/Release of Liability Form, and where legal, Publicity Release (collectively, “Winner’s Affidavit”). The potential Grand Prize winner must execute and return any required Winner’s Affidavit within seven (7) days of receipt. Non-compliance within this time period or return of Winner’s Affidavit as undeliverable may result in disqualification and an alternate winner will be selected. By accepting the Prize, the Prize winner(s) represents that he/she has complied with all rules of this Sweepstakes and will show Promoter proof of receiving prize by sending a photo of the prize to Promoter.
No more than the advertised number of prizes will be awarded. By entering the Sweepstakes, entrants agree to abide by and be bound by these Official Rules and the decisions of Promoter, which shall be final and binding in all respects. Entry and acceptance of the Grand Prize constitutes permission for Promoter to use the Grand Prize winner’s name, city, state of residence, likeness and/or photograph and statements for advertising, promotion and marketing related to or in connection with the Sweepstakes, in any and all media, and all media now or hereafter known worldwide, including the Internet and social networking sites, without further compensation, notification or permission, unless prohibited by law.
GENERAL RULES: If for any reason the Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Promoter, which corrupts or affects the administration or proper conduct of this Sweepstakes, the Promoter reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the Sweepstakes or any element thereof. Promoter has the right to reasonably change the rules of this promotion at any time without notification. Entrants, by participating, agree that Promoter, Instagram, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, delayed, garbled or damaged entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Promoter, will be disqualified and all associated entries will be void. Caution: any attempt by a person to deliberately damage any website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any entries found or suspected to be submitted in this manner will be deemed “void” by the Promoter. By sharing a photo and tagging #NationalGolfDay and @WeAreGolf on Instagram, you grant non-exclusive, transferable, sub-licensable, royalty-free, worldwide permission and consumer data to Promoter to use your image for any marketing purposes including posting on the Promoter’s website and social channels as well as for use in blogs and emails.
DISPUTES: This Sweepstakes is governed by the laws of USA, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, participants agree that any and all disputes which cannot be resolved between the parties and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the proper jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (e.g., costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
